Consumer Privacy Notice

The Firm’s Consumer Privacy Notice (“Notice”) explains how we collect, use, and disclose personal information about consumers and employment applicants (“applicants”), and provides certain rights that consumers and applicants may have under consumer privacy statutes.
Definition of “Personal Information”: “Personal information” is information that identifies, relates to, or could reasonably be linked with a particular consumer or household. This information is referred to in this Notice as “Personal Data.”
Applicants: Providing personal information to the Firm is voluntary. However, if you choose to provide information, it is your obligation to provide complete and accurate information throughout recruitment, application, and employment.
The Firm does not sell Personal Information or Personal Data to third parties.
Categories of Personal Data that We Collect and Disclose
We collect and disclose Personal Data in a variety of contexts. For example, we collect and disclose Personal Data to provide products and services, and for our employment and human resource purposes. We do not disclose Personal Data for any other purpose.
The Personal Data that we collect, use, or disclose about a specific consumer or applicant will depend on, for example, our relationship or interaction with that individual.
During the past 12 months, we have collected the following categories of Personal Data:
- Personal unique identifiers, such as full name and federal or state issued identification numbers including Social Security number, driver’s license number, and passport number;
- Personal information, including contact details such as telephone number and address, email address, email metadata, IP address, financial information such as account number and balance, payment card details including credit and debit card numbers, as well as medical and health insurance information;
- Characteristics of protected classes or groups under state or federal law, such as sex or marital status;
- Purchase information, such as products and services obtained and transaction histories;
- Internet or online information such as browsing history, and information regarding interaction with our websites, applications, or advertisements;
- Professional or employment-related information; and
- Inferences based on information about an individual to create a summary about, for example, an individual’s collecting preferences and characteristics.
During the past 12 months, we have also disclosed the categories of Personal Data listed above internally for our business purposes and otherwise with the person’s consent (e.g., in set registry profiles or forum signatures). We have not, however, sold Personal Data.
Why We Collect Personal Data and How We Use It
The purposes for which we collect and use Personal Data depend on, among other things, our relationship or interaction with a specific consumer or applicant. The table below lists the purposes for which we collect and use Personal Data in different contexts.

Sources of Personal Data
The sources from which we collect Personal Data depend on, among other things, our relationship or interaction with a specific consumer or applicant. The information below lists the categories of sources from which we collect Personal Data in different contexts.
- From consumers or applicants directly, or other individuals acting on their behalf, through physical (e.g., paper application), audible (e.g., phone), or electronic (e.g., website, email, text, social media) sources;
- Public records or widely available sources, including information from the media, and other records and information that are made available by federal, state, or local government entities;
- Outside companies or organizations that provide data to support activities such as fraud prevention, underwriting, and marketing;
- Outside companies or organizations from whom we collect Personal Data to support human resource and workforce management activities.
Consumers and Applicants have the Right to
- Request Disclose the categories of Personal Data we collected about you and the categories of sources from which we collected the Personal Data;
- Request the business or commercial purpose for collecting Personal Data about you;
- Request the categories of third parties to whom we disclosed Personal Data about you, and the categories of Personal Data disclosed;
- Request the specific pieces of Personal Data we collected about you; and
- Request that we delete Personal Data we collected from you (“Deletion Request”) or correct Personal Data we collected from you (“Correction Request”).
Note: We may not discriminate against you for exercising your rights applicable consumer privacy statutes.
Responding to Requests
We are required to verify the identity of anyone making an Access, Deletion or Change Request, and we must deny any such request if we cannot verify the requestor’s identity. In addition, privacy and data protection laws may apply to much of the Personal Data that we collect and use. When these laws apply, Personal Data may be exempt from, or outside the scope of, a particular request. As a result, in some instances, we may decline all or part of a request related to this Personal Data.
As examples, our processing of or response to an Access Request, Deletion or Change Request may not include some or all of the following Personal Data:
- Consumer Accounts. Personal Data connected with consumer accounts used for personal, family, or household purposes. We have other privacy notices describing use and sharing of this data, for example, Gurstel’s Privacy Policy, available at https://www.gurstel.com/contact/privacy/
- Employment. Personal Data about an individual who is a current or former employee (team member) or job applicant, and we use that Personal Data within the context of that individual’s role as a current or former employee (team member) or job applicant;
- Business-to-Business Relationships. Certain Personal Data we collect in the course of providing a product or service to another business, or in the course of receiving a product or service from another business.
The types of Personal Data described above are examples. We have not listed all types of Personal Data that may not be included when we respond to or process Access Requests, Deletion or Change Requests.
In addition to the above examples, we may not include Personal Data when we respond to or process Access Requests, Deletion or Change Requests when applicable privacy statutes recognize additional exceptions. For example, we will not provide the Personal Data about another individual if doing so would adversely affect the data privacy rights of that individual. As another example, we will not delete Personal Data when it is necessary to maintain that Personal Data to comply with a legal obligation.
How to Make Requests or Opt-Out of Data Collection
Consumers or applicants can make an Access Request, Deletion or Change Request by:

Changes to this Notice
We may change or update this Notice periodically. When we do, we will post the revised Notice on this webpage indicating when the Notice was “Last Updated”.

Gurstel Law Firm, P.C. (the “Firm”) is providing you with this Notice for Applicants to inform you about:
- the categories of Personal Information that the Firm collects about applicants; and
- the purposes for which the Firm uses that Personal Information.

2. Commercial Information
2.1 Purposes of Use: reimbursement of travel expenses.

3. Sensory Or Surveillance Data
3.1 Personal Information Collected: The Firm collects sensory or surveillance data, including the following: audio/visual recordings of interviews and footage from video surveillance cameras. The CCPA defines “sensory or surveillance data” as audio, electronic, visual, thermal, olfactory, or similar information that can be linked, or associated with, a particular consumer or household.
3.2 Purposes of Use: to protect the safety and security of the Firm’s facilities and personnel through video surveillance, to evaluate the applicant’s suitability for employment, and to monitor compliance with Firm policies.
4. Education Information
4.1 Personal Information Collected: The Firm collects education information including the educational institution attended and whether an applicant received a degree.
4.2 Purposes of Use: to evaluate applicants’ qualifications for employment with the Firm.
Purposes Potentially Applicable To Any Of The Categories Of Personal Information Listed Above
The Firm also may use applicants’ Personal Information to facilitate administrative functions and information technology operations and for legal reasons and corporate transactions.
These functions include, but are not limited to the following:
- to manage litigation involving the Firm, and other legal disputes and inquiries and to meet legal and regulatory requirements.
